In March 2004, the court approved a Memorandum of Understanding (MOU) brought forth by the School District of Philadelphia, Pennsylvania Human Relations Commission and a coalition of advocacy groups, and this has ended the court's jurisdiction over the case. Instead, the school district will provide an annual report detailing the District's plans on providing educational equity for all. The following are the highlights of the MOU:
- Court-ordered monitoring of the district is suspended for the next three years.
- The PA Human Relations Commission will continue to monitor the district's progress in closing the achievement gap and equitably distributing educational resources to all students.
- The district will provide an annual report to the Commission addressing: parental involvement; teaching and learning; educational improvement; desegregation strategies; resources; school climate, safety and discipline; organizational restructuring; facilities; and overcrowding.
- If any racial gap fails to narrow for two consecutive years, the School District and Commission will discuss whether a hearing on the matter should be held.
- If a dispute arises, a three-member panel consisting of appointees of the Commission and district and a nationally recognized education expert will review the matter.
- When the district is in compliance court monitoring will end.
